These terms of use apply to the games developed and published by Ngô Quang Lộc (Ngo Quang Loc), an individual game developer in Vietnam (“we” or “us”). They cover Quack Trek (Lùa Vịt Xuyên Việt) and every other game we publish on the App Store and Google Play. By downloading or playing one of our games, you agree to these terms. If you don’t agree, please don’t use the games.
Who can play
You must be at least 13 years old, or the minimum age set by the law where you live, to use the games. If you are under the age of majority where you live, a parent or guardian must agree to these terms for you.
Your license to play
We give you a personal, non-exclusive, non-transferable and revocable license to download and play the games on devices you own or control, for your own non-commercial entertainment. The games are licensed to you, not sold. We and our licensors keep all rights in the games, including their code, artwork, sounds, characters, names and trademarks.
Rules
When you use the games, you agree not to:
- copy, modify, sell, rent or distribute the games or any part of them;
- reverse engineer or decompile the games, except where the law allows it;
- use cheats, bots, hacks, mods or other unauthorized software;
- exploit bugs, or interfere with the games or their ads, including by generating fake ad views or clicks;
- use the games for anything unlawful.
Ads
The games show ads from third parties. We are not responsible for the products or services advertised, and any dealings you have with an advertiser are between you and that advertiser. If you see an inappropriate ad, tell us at support@haitinhmo.com with the time and what the ad showed, and we will look into blocking it.
Purchases and virtual items
- Some games may offer optional in-app purchases, such as removing ads or buying virtual items. Payments are processed by Apple or Google under their terms.
- Virtual items and in-game currency have no real-world value, can’t be exchanged for money and are licensed to you, not sold.
- A “Remove ads” purchase removes banner and full-screen ads in that game on the store account where you bought it. Rewarded ads that you choose to watch for a reward may stay available.
- Refunds are handled by Apple or Google under their refund policies. Except where the law says otherwise, purchases are final.
- You can restore purchases from the game’s settings when you reinstall a game or move to a new device with the same store account.
Updates and availability
We may update, change or stop offering a game or any feature. Some features, including ads, need an internet connection. If we plan to stop offering a game that has paid features, we will try to give notice in the game first.
Privacy
Our privacy policy explains what information we collect and how we use it.
Disclaimer
The games are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don’t promise that the games will be free of errors or always available.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss of data, profits or goodwill. Our total liability for any claim about the games is limited to the greater of the amount you paid us for the game in the 12 months before the claim and USD 50. Nothing in these terms limits liability that the law does not allow us to limit, or your rights as a consumer.
Ending these terms
You can stop using the games at any time by deleting them. We may suspend or end your access if you break these terms. The sections on ownership, disclaimers, limitation of liability and governing law continue to apply after these terms end.
Games downloaded from the App Store
Unless we provide our own license agreement in the App Store, Apple’s Licensed Application End User License Agreement governs your license to use a game downloaded from the App Store. These terms add to that agreement, and if the two conflict, Apple’s agreement prevails. The following also applies:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the game and its content.
- Apple has no obligation to provide maintenance or support for the game.
- If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent the law allows, Apple has no other warranty obligation for the game.
- We, not Apple, are responsible for any claims relating to the game, including product liability claims, claims that the game fails to meet legal or regulatory requirements, and consumer protection claims.
- We, not Apple, are responsible for investigating, defending, settling and discharging any third-party claim that the game infringes that third party’s intellectual property rights.
- You confirm that you are not located in a country subject to a US government embargo, and that you are not on any US government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when you use the game, such as your mobile data agreement.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law and disputes
These terms are governed by the laws of Vietnam. If you have a dispute with us, please contact us first so we can try to resolve it informally. If we can’t, the dispute will be decided by the competent court in Vietnam. This doesn’t take away any mandatory consumer protection rights you have under the law of the country where you live.
Changes to these terms
We may update these terms. We will post the new version on this page with a new effective date and, for significant changes, tell you in the games or on this website before they take effect. If you keep playing after the changes take effect, you accept the new terms.
